AQUACULTURELEASE RENEWAL
The Commissioner is considering an application to renew for ten years to July 11, 2024, a 5.98 acre lease, DAM PPN, located northeast of Perkins Point, Damariscotta River, Newcastle, held by Norumbega Oysters, Inc. for the purposes of cultivating American and European oysters, surf/hen clams, blue sea mussels, and bay and sea scallops using bottom and suspended culture techniques.

Westport Island

TOWN OF WESTPORT ISLAND
BIDS FOR SNOW REMOVAL
The Selectmen of the Town of Westport Island will receive bids on a "Per Mile" basis only, for a (3) year contract for snow removal and sanding of twenty-four and 47/100 (24.47) miles of road in the Town of Westport Island including all bus turn-arounds, Town Hall parking areas, Fire House, Town Office building drives and parking areas. Bids must include a list and complete description of all equipment that the bidder will use in performance of the contract and the Selectmen will reserve the right to inspect the equipment to be used in fulfilling the contract requirements.
The successful bidding contractor will, at his own expense, be required to carry, maintain throughout the life of the contract, and to provide to the Board of Selectmen within 14 days of contract award, Certificate of Insurance listing the Town of Westport as Certificate Holder, for the following coverages:
1. Adequate Workers Compensation Insurance for all contractor's employees employed under the contract.
2. Contractor's General Liability and Property Damage Insurance with a minimum coverage of $1,000,000 each occurrence.
3.Motor Vehicle Liability and Property Damage Insurance with a minimum of coverage of $500,000 combined single limit for each motor vehicle to be used in the performance of the contract.
In case of work subcontracted, the contractor shall require any subcontractors similarly to provide Adequate Workers Compensation, Public Liability and Property Damage, and Motor Vehicle Liability and Property Damage Insurance coverages for all the subcontractors and its employees, unless such protections are afforded under the coverages of the contractor.
The contractor will furnish the town with an irrevocable letter of Credit, Bond or Security Agreement acceptable to the Town's Board of Selectmen and is to remain in effect until the completion of the contract and shall be executed within 30 days of the awarding of the contract.
Bids must be received in a SEALED envelope either hand delivered or addressed to: "Selectmen, Town of Westport Island," 6 Fowles Point Road, Westport Island, ME 04578 and must be clearly marked on the outside, "Snow Removal Bid." All bids must be in the hands of the selectmen by 7:00 p.m. on the 2nd day of June, 2014 at which time they will be opened and read aloud at the town office.
The selectmen reserve the right to accept or reject any and all bids, to renegotiate the existing contract and to waive certain requirements as stated if it appears to be in the best interest of the town.

This is an action for the foreclosure of a mortgage on real property and may affect real property of the Defendant David M. Wheaton located at 919 Winslow Mills Road, Waldoboro, ME 04572, and described in such Mortgage Deed as recorded in Book 3920 at Page 5 in the Lincoln County Registry of Deeds, Maine.

This Court has reviewed the motion of the Plaintiff for service by publication pursuant to Rule 4(g) of the Maine Rules of Civil Procedure Rule 6(b) and finds that Plaintiff is in compliance with Rule 4(g)(1)(A)-(C).

It is ORDERED that service be made upon the Defendant David M. Wheaton by publishing a copy of this Order once a week for three (3) successive weeks in the Lincoln County News which is a newspaper of general circulation in the Town of Waldoboro and County of Lincoln in which Defendant's property is located.

It is FURTHER ORDERED that the Defendant David M. Wheaton being served by publication appear and serve an answer to the motion or complaint on counsel for Plaintiff, Stephanie Cummings, Bendett & McHugh, PC, 270 Farmington Avenue, Suite 151, Farmington, CT 06032. The answer must be filed with the Court within forty-one (41) days after the first publication of this Order.

It is FURTHER ORDERED that the Plaintiff mail a copy of the Order as published to the Defendant at 919 Winslow Mills Road, Waldoboro, ME 04572 and 1479 Barefoot Circle, Barefoot Bay, Florida, the last known addresses of Defendant David M. Wheaton.

Failing to serve an answer will cause judgment by default to be entered, granting relief sought in the motion or complaint.

The clerk may incorporate this order by reference on the docket.
