Waldoboro Lawyer Arrested a Second Time

A well-known Waldoboro lawyer was arrested for the second time in less than three weeks Dec. 4, this time for alleged violations of bail conditions.

Philip Cohen, 44, of Waldoboro, was originally arrested for alleged domestic violence assault on Nov. 15 at his home on Washington Road.

He was taken to Two Bridges Regional Jail in Wiscasset, where he was immediately released after posting $1000 unsecured bail, jail personnel said at the time.

On Dec. 4, Waldoboro Police arrested Cohen at around 8:15 p.m. for allegedly violating a bail condition that prohibited Cohen from having direct or indirect contact with the alleged victim, according to Labombarde.

A written statement by Officer Thomas Bartunek related to the second arrest alleges Cohen had been in contact with the alleged victim via telephone and text message.

A motion to amend the bail conditions to allow contact with the alleged victim was filed Nov. 27 by Cohen's lawyer, Walt McKee, of McKee Billings in Augusta.

"Upon information and belief," both Cohen and the alleged victim wish to have contact, McKee wrote.

A proposed order for the bail amendment remained unsigned in the court file as of Dec. 6.

After his arrest on Dec. 4, Cohen was held without bail until he was arraigned Dec. 6 in Belfast District Court via video from Two Bridges Regional Jail for the alleged violation of conditions of release and subsequently bailed out.

At the arraignment, Cohen entered a plea of not guilty for the charge of violation of conditions of release, a Class E misdemeanor.

Judge Charles Dow accepted a bail agreement of $500 cash bail with conditions of no contact with the alleged victim, no use or possession of firearms, and subject to random searches.

As to the original charge of domestic violence assault, McKee filed a waiver of the reading of the complaint and recital of rights and entered a plea of not guilty for Cohen on Nov. 20, according to court documents.

According to Lincoln County court personnel, a trial date for Cohen set by Dow for Thursday, Jan. 9 will likely be rescheduled because trial-related personnel in Lincoln County have recused themselves from handling Cohen's case.

Andrew Matulis, an assistant district attorney in Androscoggin County, confirmed Dec. 5 he is handling the Cohen case.
